hosting terms & conditions

These Hosting Terms & Conditions apply to all websites, hosting accounts, email services, DNS services, and related technical services provided through Giosol IT Solutions (“we”, “our”, or “Giosol”). By using our services, the client (“you” or “the client”) agrees to the terms outlined below.

Giosol provides website development and technical support services. All web hosting infrastructure, servers, email services, DNS services, performance, uptime, and related systems are operated by our third-party hosting provider, currently Verpex, under their own service agreements and acceptable-use policies.

The client acknowledges that hosting services are delivered through an independent external provider and are not owned, operated, or controlled by Giosol.

 

1. Hosting Provider Responsibility & Uptime Disclaimer

All hosting, server uptime, performance, security, backups, email delivery, and DNS functions are managed and operated by our hosting partner (currently Verpex) via the platform:

The hosting provider is solely responsible for:

  • server uptime & service availability

  • outages, maintenance windows, and downtime events

  • performance, latency, and bandwidth issues

  • infrastructure or data-center incidents

  • email deliverability & spam filtering

  • DNS propagation & domain routing

Because these systems are outside our direct control:

Giosol does not guarantee uptime, availability, email reliability, or uninterrupted service
and is not liable for downtime, interruptions, delays, or outages caused by the hosting provider or internet networks.

Clients may independently check service status at any time using the hosting status monitor linked above.

 

2. Backups, Data, Website Content & Client Responsibility

The client is responsible for:

  • website content, files, media, and uploads

  • complying with copyright and licensing laws

  • ensuring lawful and ethical use of hosted material

  • maintaining local copies of important data

  • notifying us if backup services are required

Backups may be provided by the hosting provider, however:

Backups are not guaranteed and should not be relied upon as the sole data recovery method.

Where optional paid backup services are offered, they are provided on a best-effort basis and subject to hosting-provider capability and availability.

Giosol is not responsible for:

  • accidental deletion of client data

  • client-initiated updates or plugin changes

  • security breaches caused by weak passwords

  • malware introduced by third-party software

 

3. Email, DNS & Third-Party Services Disclaimer

Email hosting, mail routing, spam filtering, DNS resolution, and domain propagation are dependent on third-party platforms and global networks.

Therefore, the client acknowledges that:

  • email delivery and inbox placement are not guaranteed

  • DNS changes may experience delays or propagation lag

  • messages may be blocked by recipient spam filters

  • email performance may vary by provider & region

Giosol is not liable for:

  • lost, delayed, or undelivered emails

  • DNS-related downtime or routing failures

  • third-party platform policy or infrastructure changes

We may provide configuration and troubleshooting assistance as a service — however, this does not transfer responsibility or liability for third-party systems to Giosol.

 

4. Security, Software & Website Maintenance

Unless the client is subscribed to an active maintenance plan, the client is responsible for:

  • plugin and theme updates

  • CMS updates

  • license renewals

  • security hygiene & password management

If the client installs plugins, scripts, or third-party code:

  • performance issues

  • security vulnerabilities

  • site conflicts or crashes

are solely the client’s responsibility.

Where Giosol provides maintenance services, they are delivered on a best-effort basis and do not guarantee immunity against cyber-attacks, malware, or platform failure.


5. Service Interruptions, Migration & Termination

Hosting services may be temporarily interrupted due to:

  • scheduled maintenance

  • emergency infrastructure repairs

  • cyber-security incidents

  • hosting platform failures

Where possible, we will provide reasonable notice — however outages may occur without warning.

If the client requests to migrate away from our hosting:

  • migration assistance may be offered as a paid service

  • responsibility for transfer risk remains with the client

  • post-migration issues fall outside our scope of liability

Giosol reserves the right to suspend or terminate hosting in cases of:

  • abuse, illegal content, or spam activity

  • resource overuse impacting other customers

  • failure to comply with hosting or payment terms


6. Limitation of Liability

To the fullest extent permitted by law:

Giosol is not liable for:

  • hosting outages or downtime events

  • loss of revenue, traffic, or business

  • email or DNS delivery issues

  • third-party service failures

  • malware, hacking, or cyber-attacks

  • loss or corruption of client data

Our role is limited to technical configuration and support services only.

Responsibility for infrastructure performance remains with the hosting provider.

 

7. Acceptance of Terms

By using our hosting or related technical services, the client confirms they have read, understood, and accepted these Hosting Terms & Conditions.

These terms may be updated periodically. Continued use of hosting services constitutes acceptance of any revised version.
